Terms of Service
These are the rules for using Swag Swap. They are written to be read. By creating an account you agree to them.
1. What Swag Swap is
A place to find people nearby and trade things with them, in person. Swag Swap is not a party to your swaps: we introduce you, give you tools to agree, and step in when something goes wrong. The swap itself is between you and the other person.
2. No money, ever
Swag Swap is cash-free. You may not ask for, offer, or accept money, gift cards, points, credits, or anything that works like money, inside the app or alongside a swap. If two items don't match in value, add items to one side until they do. Listings and messages that involve money are removed and repeat offences lead to a ban.
3. Who can use it
You must be 18 or older and verify your identity before posting or meeting. One account per person. You are responsible for what happens under your account.
4. What you may not list
Anything illegal to own or transfer where you are; weapons; drugs and prescription medicine; alcohol and tobacco; counterfeit goods; stolen goods; live animals; anything you don't own; anything sexual or that depicts minors; and services or promises rather than things. Listings are reviewed and may be removed without notice.
5. Meeting in person
Meet in public places, in daylight, and inspect items before you confirm. Both people confirm the swap in the app; a swap is complete only when both have. You meet at your own judgement — verification tells you the other person is who they say they are, not that every swap will go well.
6. The Swag Swap Guarantee
[Counsel to draft — D12.] Must state precisely what is covered (a completed, dually-confirmed swap where an item was materially not as described), what is not (change of mind, damage after the swap, items the rules forbid), the window to open a dispute, and what the remedy is. This wording is a promise the app already displays; it must match the in-app Guarantee copy character-for-character.
7. Disputes
Open a dispute from the swap within the window. We look at the listing, the chat, the confirmations and any evidence you both add, and decide. Our decision inside the app is final; it does not remove any rights you have under the law where you live.
8. Conduct and enforcement
Be honest in listings and decent in chat. Harassment, threats, scams, and no-shows are reported and reviewed by our team. Consequences escalate: a warning, a listing removal, a temporary restriction, then a permanent ban. A banned person may not return under another number. You can appeal by writing to us with the case reference shown in the app.
9. Your content
Your photos and words stay yours. You give us permission to show them inside the app and in share links, and to keep copies needed to resolve disputes. Don't post what you don't have the right to post.
10. Ending things
Close your account any time in Settings. We may suspend or close accounts that break these terms. Sections 6–8 survive closure for swaps that already happened.
11. Liability, law, changes
We provide the app as it is and do our best to keep it running. To the extent the law allows, we are not liable for what happens between members beyond the Guarantee in section 6. These terms are governed by the laws of [jurisdiction]. If we change them in a way that matters, we tell you in the app first.
